Standard Warranty Terms
EVRCOOL, Inc. (“Seller”) warrants that all goods and equipment provided by Seller shall comply with their applicable specifications and documentation for a period of 18 months from the date of installation (“Warranty Period”), provided the end user (a) uses such goods and equipment as intended and in compliance with the applicable documentation, including without limitation, the applicable product manual; and (b) follows the preventative maintenance schedule as set forth in the applicable product manual.
In the event of a valid warranty claim during the Warranty Period, Seller’s obligation and buyer’s sole and exclusive remedy, is limited solely to repair of the applicable goods or equipment, as described below. For customers in the United States, Seller will pay for the costs of replacement parts and labor needed to repair the applicable goods and equipment at no charge to buyer . For customers located outside the United States, Seller’s obligation to repair the applicable goods and equipment is limited to providing replacement parts at no charge to buyer.
In the event Seller replaces the applicable goods or equipment, buyer will promptly return the non-conforming goods or equipment to Seller, at Seller’s expense and in accordance with Seller’s instructions.
The above warranty will not apply to any goods or equipment, or components thereof, which have been subject to abnormal or improper use, negligence (including failure to maintain the goods or equipment in accordance with the applicable product manual or as otherwise recommended in writing by Seller), accident or any repairs made by a buyer, or another third party not approved by Seller.
Nothing shall be construed as an extended warranty unless specifically designated as such in writing and signed by Seller (“Extended Warranty”). The Extended Warranty shall be subject to the terms and conditions herein as to duration and limitation of remedy, unless the Extended Warranty expressly amends such provisions.
EXCEPT AS OTHERWISE SET FORTH HEREIN, ALL OTHER WARRANTIES AND REPRESENTATIONS, EXPRESS OR IMPLIED, AS EXCLUDED BY THIS WARRANTY POLICY. THERE ARE NO WARRANTIES THAT EXPAND BEYOND THE DESCRIPTION HEREIN. SELLER’S WARRANTIES HEREIN APPLY ONLY TO THE ORIGINAL PURCHASER AND DO NOT EXTEND, EXPRESSLY OR BY IMPLICATION, TO ANY OTHER PERSON OR PERSONS.
